Liability Waiver
I (We) hereby make application for membership in the Bonneville Cycling Club (“club”). I (We) understand the objectives as follows: “to promote the general interests of cycling in all its phases, to encourage and facilitate touring, cycling outings, and all forms of cycling activities; to defend and protect the rights of cyclists, to secure a better understanding and recognition of the need for safer riding conditions to encourage the allocation and facilities for cycling on public land; to cooperate with public authorities in observance of all traffic regulations; and to advocate recognition of the bicycle as a vehicle used for pleasure, health and economical transportation.” (Article III, BCC Articles of Incorporation) I (We) hereby waive, release, and discharge any and all claims for damages of death, personal injury, or property damage that may exist or hereby accrue to me (us) as a result of the club. This release is intended to discharge in advance the trustees, officers, members, participants, promoters and sponsors of the club from and against any and all liability arising out of or in any way connected with the participation in the club even though that liability may arise out of the negligence or carelessness of the above mentioned persons or entities. I (We) further understand that serious accidents occasionally occur while riding a bicycle and that participants in bicycling activities occasionally sustain mortal or serious personal injuries, and/or property damage as a consequence thereof. Knowing the risks of bicycling, nevertheless, I (We) hereby agree to assume those risks and to release and hold harmless all of the persons or entities mentioned above who (through negligence or carelessness) might other wise be liable to me (us) (or my (our) heirs or assigns) for damages. It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my (our) heirs or assigns.
